§ 1 Definition

Atelier Blyss: general partnership company established under the Swiss Law in 2022
Site / Website: www.atelier-blyss.com and all its subdomain
User / Customer: any individual visiting and/or interacting with the Site. Any recipient of content created by Atelier Blyss such as ads and emails.
Product(s): the product(s) offered on the Site.
Client: the natural person or corporation who enters into an Agreement with Atelier Blyss
Agreement: any arrangement or agreement between Atelier Blyss and the Client

§ 2 Scope

The general terms and conditions apply to the entirety of services provided by Atelier Blyss and all Agreements which are created between Atelier Blyss and the Client.

§ 3 Conclusion of contract

All Product’s information and prices within the ordering process is subject to change and non-binding. It does not constitute a legally binding offer.

A binding offer is concluded on the Customer’s part as soon as the Customer has completed the payment process for the desired item when ordering through our Website. Atelier Blyss is entitled to accept the offer within 14 calendar days by sending a contract confirmation (order confirmation by email). Should the offer not be accepted within this period, the offer shall be deemed to have been rejected.

As long as the Products have not been delivered, they are still the full property of Atelier Blyss. As soon as the Product has arrived at the delivery address provided by the Customer, the property as well as the risk for the Product is fully transferred to the Customer.

§ 4 Shipping & Return

§ 4.1 Pre-order

Atelier Blyss works with a pre-order system. A pre-order is an order placed for an item that hasn't been released yet. The Customer will be notified when the pre-order period is open so that the Customer can place his/her/their order within this period. Four to six weeks are required for production and shipping.

§ 4.2 Shipping

As soon as the Customer's order has been packed and shipped, the Customer will receive a confirmation per email.

We ship worldwide. Unfortunately, due to our website provider, it is not possible for us to ship to the UK.

Orders are shipped from Lucerne, Switzerland or Fribourg, Switzerland. The estimated shipping times depend on the Customer’s location. The estimated delivery times are listed below. This information is for guidance only and is not binding.

Switzerland: 4 - 5 business days

Within Europe: 5 - 10 business days

Outside Europe: 10 - 18 business days

The final cost of the Customer’s purchase will include the shipping at the final checkout. Separate charges such as duty or custom charges might occur additionally, and are not included or covered by Atelier Blyss.

If the transport company sends the goods back to Atelier Blyss because delivery to the Customer was not possible, the Customer has to bear the costs for the unsuccessful shipment.

Pick-up by the Customer is not possible due to logistical reasons.

§ 4.3 Return

The Customer has the option to return a Product within 14 working days from the date of arrival. The costs for the return are to be borne by the Customer. After the deadline, a return is no longer possible.

The following steps are mandatory for proper return:

1. The return must be registered by the Customer by e-mail to info@atelier-blyss.com including the order number and the reason for return. Afterwards the Customer will receive the return address information.

2. All garments must be returned unworn, in 100% resalable condition and in the original packaging. The original labels must be attached to the Product. If Atelier Blyss receives returns that do not comply, they will be returned to the sender and no refund can be made. The shipping cost of the returned package is the responsibility of the Customer.

3. Once Atelier Blyss received the return and inspected it, Atelier Blyss will refund the Customer's money via his/her/their credit card (or original payment method). The period in which the Customer receives his/her/their money back varies, depending on the policies of the respective card issuer.

Atelier Blyss will only issue a refund, if all of the above steps have been followed.

If the order is placed outside of Switzerland and the return involves customs charges, these are the responsibility of the Customer and will be subtracted directly from the refund. It is up to the Customer to find out how to declare the goods before sending his/her/their return in order to avoid additional costs.

§ 5 Prices & Terms of payments

All prices displayed on the Website include the Swiss added tax (8,1%).

The following payment options are available:

Credit card and Klarna.

If the Customer decides to use Klarna as payment option the amount invoiced must be paid to the account specified on the invoice by the due date specified on the invoice form (usually 14 days).

If Atelier Blyss hasn't received the Customer’s payment after the payment deadline, the Customer will have to pay default interest of 8%. Atelier Blyss reserves the right to charge additional fees of CHF 5.- for the first reminder, CHF 10.- for the second reminder, and CHF 20.- for the third reminder. We reserve the right to claim further damages.

§ 6 Product care

For proper care of the Products, the Customer is advised to follow the laundry instructions, which can be found on the labels of the items.

There is no case of warranty, if the care instructions are not followed properly, if changes are made to the Products or if care materials are used that are expressly not recommended or that do not meet the average requirements in terms of quality.

§ 7 Copyright

The designs and motifs of Atelier Blyss Products are protected by copyright and, where relevant, other intangible assets and other rights. The use or reproduction of the motifs and designs is only permitted with written consent of Atelier Blyss. Payment for the Product via the Website does not grant the Customer any right to use property or copyrights.

The design of the Website as well as its content are protected by copyright. Modification, reproductions or copying of any kind is prohibited. 

§ 8 Complaints handling procedure

If the Client would like to address a complaint regarding a Product, a service or a section of the Site, it can contact Atelier Blyss by email. The contact details can be found in the footer of the Site.

Atelier Blyss will respond to the complaint in the shortest possible time and do its best to provide a substantive response.

§ 9 Data protection

The processing of personal data of Customers by Atelier Blyss is limited to the information strictly necessary for the usage of the Website and its services as well as the execution of the contract or the data that the Customer has actively provided. This usually includes:

· First name and last name;

· Email address;

· Telephone number;

· ZIP/Postal Code;

· Streetname + number;

· City;

· Region;

· Country;

· Payment details.

Atelier Blyss highly values the Customer’s privacy and no data is handed over to third parties. However, no liability can be accepted for the security of the data transmitted on the internet. Atelier Blyss hereby expressly draws attention to the risks beyond its control that are connected with data transfer by email. These risks include the transfer of viruses, damage to and/or loss of data, and unauthorized third-party access. Atelier Blyss can not be held responsible for any of the above-mentioned points.

Atelier Blyss reserves the right to use information such as the Customer’s email address for marketing purposes or newsletter. The Customer has the right to request Atelier Blyss to not use his/her/their email address for marketing purposes or newsletter by sending an email to Atelier Blyss specifying his/her/their request and proving his/her/their identity.

§ 10 Disclaimer

Although every care has been taken by Atelier Blyss to ensure the accuracy of the information published, no warranty can be given in respect of the accuracy, reliability, up-to-dateness or completeness of this information.

Atelier Blyss has made every effort to display as accurately as possible the colors and images of its Products. However, no warranty can be given in respect of the accuracy, reliability, up-to-dateness or completeness of the visuals.

Atelier Blyss reserves the right to alter or remove the content, in full or in part, without prior notice.

Atelier Blyss does not warrant that the quality of any Products, services, information, or other material purchased or obtained will meet the Customer’s expectations.

The Site may contain links that lead to other Websites. Third party Websites that fall outside Atelier Blyss’ domain lie outside the scope of responsibility of Atelier Blyss. This means that responsibility for information and services of linked Sites rests entirely with the relevant third parties. Atelier Blyss manages different accounts and profiles on social media. These pages and services are offered and operated by third parties which have their own terms & services and data collection system and are in no case linked to Atelier Blyss.

Furthermore, any liability is excluded to the extent permitted by law.

§ 11 Change of terms & conditions

Atelier Blyss expressly reserves the right to unilaterally change the present general terms and conditions at any time without prior notice. By visiting and using the Website after the aforementioned modifications, the Customer agrees to be bound by the general terms and conditions in force at the time.

§ 12 Applicable law /
place of jurisdiction

In any event, the relationship between the Client and Atelier Blyss is governed by Swiss substantive law, excluding the provisions of international private law and the CISG.

Any disputes arising out of or in connection with the relationship between the Client and Atelier Blyss shall be subject to the exclusive jurisdiction of the ordinary courts in the city of Lucerne, Switzerland. The parties shall endeavor to resolve any disputes arising from the contract amicably.
